DISPUTE OVER PIANO.
A DEAL THAT LAPSED. An interesting case- came before Mr. J. Poynton at the Magistrate's Court, Otahuhu, during the week, when Claude Over, piano expert, sued A. Carroll and wife, of Otahuhu station, for the nondelivery of a piano. Mr. J. Sullivan appeared for plaintiff, and Mr. C. Mahoney for defendants. The plaintiff, giving evidence, stated that as the result of an advertisement lie bought a piano from defendant, paying f 1 deposit, with the proviso to complete the purchase by forwarding the balance, £9. This he did three days later. Subsequently the whole amount was refunded, an accompanying letter stating that the instrument was a gift, and that it was not desired to sell the same. Mr. and Mrs. Carroll contended that the reason for returning the money was that it was not paid within the prescribed time. Under cross-examination it was admitted that their action was partially because the piano was a gift. The S.M., after expressing a desire to see defendants' letter intimating that the deal was off, adjourned the case to Auckland.
