An originating! samiuoua was heard by .Mr Justice Iloskin:: in the Supreme Court this morning The factmwpre that Archie Keulji-n Bnmton, a private in the Ist Auckland Infantry, nisule a will prior to leaving for the front, and before going' into notive service he filled up the form; of soldier.-' will provided at the end of! the soldier-i' pay book in identical terms | of the will lie had executed prior to leaving New Zealand. Nothing wae known of the soldier's death until some time after probate had been granted of the first will, bit having regrard to the fact tha.t the soldier's will contained a printed clause revolciris all prior wills it hae been| necessary to obtain an order for the re-1 rail of the probate of the (ir.st will before probate of the second will could be granted. It was frranted by consent. The late TVivate l!r\mton was killed on i February (i last. Mr. S. E. Greendftle appenred on behalf of Mr. R- A. Singer for the parties concerned.
