Tile editor of the New Zealand monthly publication, "The Triad" (Charles Nalder Baeyertz). is suing the proprietors of "Tlie Theatre." a magazine, claiming £1.000 damages tor alleged libel, contained in a paragraph referring to a criticism published in "The Triad" by the plaintiff. Plaintiff contends thai the paragraph inferred that ho was a (iernian, and wae, therefore, disloyal and unworthy of trust and confidence, whereby plaintiff was injured in his credit and reputation. The alleged libel was contained in the following paragraph: "That unconscious comedian of culture, 0. X. BneyerU, accuses Klsie Spain of making Vrs" of all her - ors." It is very painful, ridiculous, and strange that llerr Baeyertz, of all people, should lodge this complaint, as he suffers in spelling what he alleges of the English girl in song." I'aintifTs counsel stated that early in 1914 plaintiff came to Sydney to arrange for the publication- of" an" Australian edition, but the project was suspended owing to the war. "The Theatre" magazine had attacked plaintiff personally, affording evidence of malice. Plaintiff contended that his criticism of Elsie Spain wan not objectionable.
