Witness said he had had enough, whereon accused replied. "You'll have some more." and struck him twice on the chin. Witness fell on his back, and Nightingale turned to leave, remarking as he did so. "Ii" I get the sack over this job I'll give you more next time." Witness was attended to by :■ resident, and had to go to tlie hospital with a broken jaw. He had not spoken to accused at the time: only smiled at him.

To Mr Stewart (for accused): Witness had a meat round at Northcote, and accused a round at Birkenhead. There was a certain amount of hostile feeling on both sides. He bad tint spoken to accused for over 12 months; had som___ times smiled, but bad not sneered at him.
