(Before Mr C. C, Kettle, S.£L) HIRE OF A HORSE. The hire of a draught stallion was the subject of on action brought by W.and IL Smale, carriers, of Takiipuna and Northcote, for the sum of £10, against J. S. liucklauil, auctioneer, of Gisborne. Mr J. 11. Gregory appeared for the plaintiffs, and Mr W. I*. Endean for the defendant. For the 'plaintiffs it was contended that the stallion wus hired out to him in consideration for the paymenf.qf flo and a guarantee.to lend them a draught horse to take its place. Tlie defendant lent them, they stated, urst a light draught mare, and subsequently a horse belonging to a third party. He had often promised to pay the money -when he had it. The defendant, in evidence taken at Ho'torua, stated that the loan of the mare and the other horse was Intended to off-set the loan to him of the stallion, and that he had arranged this with the plaintiffs iv lieu of payment. His Worship held that the weight of evidence was iv favour «of plaintiffs, and gave Judgment for them for the amount claimed jyltli costs. DEBT CASES.
