The Appeal Court, -before Judges Sir Joshua Williams, Denniston, Sim, Edwards, sat to hear an originatory summons moved into Court by agreement between G. P. Doneliy, Hawke's Bay, and the Commissioner of Taxes. The questions for the Court's consideration arise in connection with the interprets" tion of section 56 of the Land and Income Assessment Act, 1908. By will the testatrix devised to her husband (plaintiff) all her interest in the Waimarama blocks, subject to 1 certain conditions. These conditions" have not bejn filled, and plaintiff's present occupation is by agreement with the trustees until they should require possession thereof for purposes of sale subject to the payment of interest on certain mortgage monies secured on .»he properties. Messrs. H. D. Bell.and Lewis appear for tho pJaintiff, and the Solicitor-General for the Commissioner.'
