Just before he was arrested he had made a disturbance in hie own house, threatening a lodger with an axe, and using vile language. The character given to the man by Constable McKay, who arrested him, was that he was a drunken waster, that he was continually ill-using his wife and family, and that he did not work to support them. A decent looking young man named William Peters was charged with having assaulted Alexander Mackie and John Fraser. Peters lives in a boarding house in Federal-etreet, and on Saturday night he got very drunk. Mackie came to the house and had talked for a time to the landlady, when Peters came and struck him on the face with a bottle. Then the two had some sort of tussle, of which Peters probably had the worse 3 for he ran back into the house and emerged some moments later armed with several bull bottles of ale. These he threw promiscuously out into the street, probably aiming them at Mackie, but the only one of them which struck any person was one which hit Fraser, a mere passer-by who had no interest in the row. There was evidence also that accused threatened Mackie with a razor, but no notice whatever was suggested for accused's extraordinary conduct. On behalf of accused it was suggested by his counsel, Mr. Lundon, that Mackie was the real aggressor in that he was on the premises when he had no right to be there, and dared Peters to put him out. Accused did not deny that he was drunk. Accused was convicted, fined £1, and ordered to pay costs, £1 14/.
