HOTEL LICENSE TRANSFER.
LANDLORD'S OBJECTION OVER- ' RULED. CHRISTCHURCH, Saturday. At the Supreme Court to-day argument was heard on an originating summons issued under the Licensing Act, 1908, relating to the Rotherfield Hotel. The summons was taken out to decide a question arising out of the refusal of the landlord of the hotel, C. Deal, to consent to the transfer of the lease and license from the present tenant to Daniel C. Kelleher. Section 179 of the Licensing Act provides that a landlord shall not arbitrarily or unreasonably withhold his consent to a proposed assignment. After hearing evidence, His Honor decided that the refusal to consent to the assignment was unreasonable, and he ordered the landlord to consent to the assignment. Mr. Cassidy appeared in support of the summons, and Mr. Stringer to oppose. This is claimed to be the first case of the sort heard in New Zealand.
