At the last two meetings qf the Auckland Bricklayers' Union considerable discussion took place over the recent, decision of the Arbitration Court re the repairing of the brick kiln at Avondale. In clause 2, sub-clause (b) of the bricklayers' award, it states: "All bricklayers shall be paid at the rate of time and aquarter for repairing boilers and furnace work of any description.' , A local contractor had the job of repairing a brick kiln at Avondale, and the workers' union contended that the pay should be at time and a-quarter, being repair work. The employer refused t 0 pay the extra mouey. on the ground that the clause quoted referred to repairs done while the furnace was hot, or dirty, whereas this was practically new work;, hence the interpretation asked for and subsequent decision, in which the Court upheld the contractor. The Union has received t.hu decision with murh dissatisfaction, and consider it as an injustice to the members. The clause was drafted by the Union and accepted by the Court, and ii shows how easy it is j to read into the clause a meaning that I was never contemplated by the fra.mers. j of- the section. It is only fair to point out that the interpretation is fn respect of that job only, and does not affect the award in its application to repair-work generally in the district.
