APPEAL COURT ARGUMENT. <By Telegraph.—Press Association.) WELLINGTON, Wednesday. The hearing of the case, Borough of Jrey Lynn (Auckland) v. the iank of New Zealand Assets Realisation soard, was continued by the Appeal Jourt this afternoon. Mr. Hosking contended that there was io evidence of the dedication of these oads to the public disclosed by the facts, .'he question as to whether the roads lecame public roads before the Newton toad Board became a borough was pureiy question of inference. From the facts isclosed in the case, the proper inference fas that there was no complete dedicaion. Mr. Hosking further contended hat under the true construction of the lunicipal Corporation Acts there was no aanner in which these roads could beome public streets since the incorporation f the borough. Mr. Skerrett contended tha" " the onstruction of the Municipal Corporaion Acts these roads could not have been rivate streets when the plaintuT borough ?as incorporated, but were public highrays, and therefore became vested in the orough.
