■m-' ■ — ■ • CASE BEFORE COURT OF APPEAL. (By Telegraph,—Press Association.) WELLINGTON this-day.-The Appeal Court sat to-day, the Bench being occupied by. Judges Williams (presiding), Denuiston, Edwards, Cooper and Chapman. The Court began the hearing of the case, Borough of Grey Lynn, Auckland, versus the Bank-of New-Zealand Assets Realisation Board. This was a special case moved by consent into the Court of Appeal. Plaintiffs called upon the Board to form one street, and to construct a footpath oh.another street. De» fendants claimed"' that ""the "streets - Were pubUc streets, and declined to carry out the wor_. The Borough Council then executed the work, and claimed" to..recover £ 63, the Board's share of the cost. The guestdon for the Court .to .decide, is as to whether the streets are"public--or; private. Mr. Hosking, j_.C.,- and Mr." Reid appeared for the Council, and Mr. Sker-'-rett, EX.,andMr.Hanna for the Board. Argument is proceeding. ~ ' ~,„ ™"
