IN BANKRUPTCY.
I A special.meeting* of creditors in the bankrupt estate of Robert Frater, contractor, Devonport, was held, in the office of the official assignee, Mr. EJ Gerard, yesterday afternoon. Mr. .W. T. Gulliver (Taupo Totara Timber Company) moved: "That this meeting requests the assignee to cause a public examination of the bankrupt to be held at an early date, and that the creditors present guarantee the assignee pro rata to their claims any costs and expenses incidental to such, public examination." Mr. D. Doull seconded. Mr. A. Alison, jnr., solicitor for bank--nipt; made an appeal on his behalf, stating that he was a young man, and he had failed really through incompetency. He was not fit to take up contracts. The first job he took was guaranteed bybankrupt's uncle, in the second tbere was no such guarantee, and creditors should' have made some inquiries before giving him credit. Mr. Gulliver said that before ordering material for the second contract, bankrupt distinctly gave him to understand that his uncle would again guarantee the creditors. The Chairman stated that there was some material to warrant a. public examination. If he thought different he would veto it, but tbere was material, and therefore he had no reason to express a view contrary to the desire of the creditors. In answer to a creditor, the assignee explained' that if a public examination were made and the information then elicited warranted it, the Crown Solicitor would then issue a-certificate for "prosecution, and the matter would then pass out of the creditors' hands. The creditors then retired to confer on the matter, and on returning, Mr. Gulliver said be would like to withdraw his resolution. Permission was granted, and the meeting adjourned. i
