EARL AND HIS WIFE.

COUNTESS OF SHREWSBURY'S ALLOWANCE.

Tbe affairs of the Earl of Shrewsbury and Talbot and the countess, his wife, were again before tbe London Courts on Monday, January 28, when Lady Shrewsbury sued for ber quarterly allowance of £950. This sum represents an instalment (les. income tax) of the £4000 a year to be paid to the countess, after their separation ir. 1596.

The money was due on December 25 last, and the defence is that the earl has tendered the amount, and that at the time the action was started Laxly Shrewsbury was not in the United Kingdom.

In March, last year, Lady Shrewsbury gave authority to Lord Shrewsbury to pay her allowance to the London and Westminster Bank, because she was often abroad. The receipt from the bank would be a sufficient discharge to Lord Shrewsbuxv. The earl's solicitors wrote that they did not for a moment suppose that his lordship would like to pay the amount into the London and Westminster Bank, but would require the personal receipt of her ladyship.

Mr Justice Kennedy said the defendant was to blame for not having complied with his legal duty, which was to pay the creditor who not only told him where to pay, but to pay to her account at the bank,' and who was quite ready to give a receipt for the money, which defendant in bis lordship's opinion, was not justified in refusing.

Judgment was given for the plaintiff for *BSP_ Ktt- «*ts,._
