(Before Mr O. C. Kettle, S.M.) I'luintiff Nonsuited.—ln the case or Rk-h----.irU Henwood v. J. R. Lundoii, in which the plaintiff claimed £13 12/, His Worship nonsuited the plaintiff. Evidence had been heard, and Mr Kettle said that the point in dispute was as to what were the instructions to Mr Luudon by a witness named Foley. He regarded the latter as practically the plaintiff in the case, and he had admitted a prejudice again3t Mr Lundon, also that he had threatened to taie the defendant before the Law Society. He therefore nonsuited the plaintiff, and upon Mr Lundon'9 application allowed a guinea costs in respect to the appearance of a solicitor to argue the legal points oa behalf of the defendant. A Defended Ccse.—Mr Slteiton appeared on behalf of Adrian Wilkins, against whom Matl Lovich claimed £4 tj/1 for moneys. alleged to have been paid on the defendant's account. After hearing the evidence His Worship gave judgment for the plaintiff, With costs, to the estent of £1 4/, which the defendant had admitted in writIns to be due.
