The case Foley v. Preston, charged ■with obtaining possession of a horse under false px-etences, was continued this morning before Messrs D. Campbell and Max D. King, Justices. Mrs Foley gave evidence as to a discussion; over the horse in the bush between her husband and accused, and who, she alleged, had represented his (accused's) cousin as a constable. The case was adjourned till noon. J. McCarter, a first offender, was convicted and discharged for dmnk and disorderly conduct in the main street.
Mr Burton addressed the Bencti at some length, submitting that no criminal intent existed, because accused believed that the horse in dfspute was his property. The Bench announced that they held that no prima facie case had been made out. and they would therefore dismiss accused. ..:>'
