DEFENDED CASE
Wm. Barnaby and Win. Henry Pluiumey (executors of the will of Isabella TSriscoe) v. John Briscoe, claim for return of furniture, or £172 18s lOd and damages, £5. Mr M. McGregor (instructed by Mr A. Brock) appeared for plaintiffs, and Mr Cotter (instructed by Mr Thorne) for defendant. The furniture was claimed by the executors as part of the estate, and was now in the possession of defendant. The defence was that the goods were bought and paid- for by the defendant, and bank cheques were produced proving- that amounts had been paid by the defendant for the goods forming the principal items of the claim, and that the receipts were made out in the deceased woman's name. His Worship entered a nonsuit -without costs.
