A CUSTOMS PROSECUTION.
FINE OF £25 IMPOSED
At the Police Court this morning, before Mr T. Hutchison, S.M., John Foss was charged with having in his possession on the 4th inst. certain uncustomed goods, viz., 201b tea, 241bs cocoa, 181bs tobacco, lllbs flannel, whereby he had forfeited £100, for which the Commissioner of Trade and Customs elected to sue.
Mr McAlister conducted the prosecution, instructed by the Collector of Customs. Mr Cooper appeared for the defendant and pleaded guilty. He said that though the section under -which the information ■was laid provided for a, penalty of £100, .the Magistrate had power under section 260 of the Act to reduced the penalty to a fourth. He asked that the line might in the present case be reduced to £25, one-fourth of the penalty. Mr McAlister said that the collector agreed to the mitigation of the penalty, provided that the defendant paid all costs of the case.
His Worship accordingly imposed a fine of £25, with costs.
