Mr-Justice Hood; has delivered judgment, iii the Balimba case. The crew recently for refusing Sunday duty were ordered by the District Court magistrate to be imprisoned till the rising of the .Court. The men appealed on the "ground that under the Statute of Charles 11. the captain's commands to work on Sunday were not lawful. Justice Hood held that the seamen did not come under this Statute and 'upheld the magistrate's decision, ' . ■
