MAGISTRATE'S COURT.
FRIDAY.
(Before Mr H. W. Brabant. S.M.) Jas. Wilkinson v. Joseph Partington. —Claim £20 lis, and return of certain goods, or £25 in addition to the above sum. There Avas a counter claim of £11 Is put in by defendant. The statement of claim set forth that plaintiff leased the Avindmill, in Symonds-street, to defendant on November 4th, 1892, for three years, at lis per Aveek. By the lease defendant covenanted to keep and also deliver up the premises and machinery in good repair and condition. Plaintiff gave defendant notice to quit on the 23rd ult. Defendant on quitting had not delivered up the premises in good repair, nor had he given up the Avhole of the machinery, having removed some of it. Plaintiff noAV sued to recover I the machinery so removed, or £25 in case possession could not be had, also £o ! damages for their detention, also £15, j being° cost of replacing the several articles removed by defendant, and lis ; rent.—Defendant's counter-claim was for i certain articles connected with the premises.—Mr Theo. Cooper appeared for plaintiff, and Mr S. Hesketh defended. Evidence Avas given, after which the case was adjourned to Thursday next. Jas. McLean v. E. C. Beale—ln this ' case judgment for £42 13s Avas obtained in i the Thames Warden's Court, and judg- | ment creditor noAV sought to have debtor I examined as to means.—Mr SteAvart ap- ! peared for the judgment creditor, and Mr | Feed for the debtor. The latter contended ' that the only Court where the case could jbe beard Avas that whence the judgment I summons issued.—His Worship upheld the objection, and ruled that he had no jurisdiction to hear the case.
