Budge for the Gem of Tairua special claim, which waa objected toby the Kauri Timber Company on tho ground ot encroachment on Paknrarahi No. 1, occupied all the afternoon. Mr Jackaon Palmer, who appeared for the applicanb, addrcasad tho Court upon the history of Pakararahi No. 1 and adjoining blocka. An agreement of November 9bh, 1867, by which tho natives ceded Pakararahi for mining purposes (although nob validated), was pub in evidence. The agreement of 1368 and proclamation by Jftmos Mackay of April Sth, 187r>, including L'ukararahi within the goidtiokia, were the chief points enlarged upon, and Mr Palmer stated that frota 1875 till the present day the Government had continuously held mining rights in tha block, and Govern-1 ment tenants had been continuously mining i thoreon. The Warden eUted that "in-! eluded on goldfielda " meant nothing. Mr Palmer admitted that within a goldfiold there might bo laud which is nob Crown land, but it was diflorant when a particular block waa proclaimed as part of a goldtieid. With regard to tho Union Sash and Door Company, that was incomplete in ISS2, and wa< completed in 18S4. In response to notice the other aide had failed to produco that portion of thoir title, tho Warden pointed out that tho Company could not possibly do so, aa the surrender of that portion of the titlo to the Registrar waa compulsory. Mr McCormick. who appeared for the objectors, concurred in this, and, after further argument. The Warden said ho would not give judgnionb in tho proaont case till tho Supremo Court had given judgment in the appeal in tho Mount Morgan caao. Evidence was given by Mr Budge, Ngakapa, Hori YVbunanga, Hoteroni Taipari and James Mackay, all of whom referred to the y^reemoat made with the natives re tho purchrmo of land for mining, and showed that Pakararahi had been caded to the Crown, two nativo witnesses certifying to having ginned tho agreemont. Evidence wa3 alao giren by Jas. Jordan and F. H- Whalley, after which the ca36 was adjourned for judgment.
