At the sitbing of tho Supreme Conrt in Chambers this morning, judgmenn was given by'Hia'fioiior, Mr Justice Conolly, on the motion re S. C. Caulton, bankrupt, ir.oved by Mr Campbell at the Banco sitting a few daysago.to show cause why tha Official Assignee's decision rejecting Messrs L. D. Nathan and Co,'a proof of debt should not be; reversed. His Honor hold that the Official Assignee' was right in his contention thab Nathan and Co. had no right to claim for more than £264 and the balance of £135, and dismissed che summons withqut.coats. Mr McAlieter appeared for the Official Assignee. In the case of VV. C. Brackkenbury v. the Public Trustee, originating summons to iaterprab tho will tha late Maria Valentine Brackeabury, His Honor held with Mr Cofcter that Mrs Brackenbury died intestate as to the book debts, the money in the Bank of New Zealand (£69), and as to the shares in the New Moanataiari G.M. Company, Ltd., the \srul applying only to the property enumerated end expressly described. He considered also thab the residue which, under certain circumstances went to the Benevolenb Society, muab be taken to mean that part* of'the estato; which was left to the trustees for investment.- -Aa to the other pert of the estate be held there was intestacy. His Honor allowed £5 5a coats to plaintiff and £2 2s each to tho Benevolent Society and Public Trustee, these coata to ■coma oub of tho residue of tho estate. .
