Northcroft, SM ,) City By-laws.—David Parker was charged with having on the 24 Juno boen guilty of wanton! driving, by racing- a tramcav in Porisonby while he was in charge of a borough stage carriage. —Mr • Cotter appeared' for the City Council, and Mr Bras3ey-for- the defendant.—Several witnesses gave evidence,. alleging ' bhat Parker raced , past the tram two or three times,-in order, it appeared, to pick up what passengers were' waiting for the tram.—The' defendant's evidence was to tho effect-that the tram in question must have started seren or-eighb minutesbefore its time. Instead of an information having been laid against him, it ehould have been laid against) the Train Company foi 1 starting before thoir time. To" Mr Cotter witness stated that he had nob told that to his solicitor nor to the City Council.— Dr. Owen and Thomas Beale, who were passengers bj Parker's bus; deposed that the defendant 'did nob drive at a much faster rate than,usual, bub' admitted that 'Parker passed the' tram-several times in order to get. ahead of the tram.—His Worship said he. waa perfectly certain that the defendant) wag guilty of the offence of wantondriving. -Defendant's own witness has etfen given evidence against him. His iYorship was also of opinion that Parker did not keep to his time table, otherwise his racing" past)'the train' would nob have occurred, but as there were two other cases against tho same defendant, he would-, fine him later on.— Defendant was then charged with having or, the Ist of June,failed to leave ( his stand Tib the tin;ie appointed by the'Ciiy Council. —He pleaded guilty, as he did not, he said, remember anything about the commission of the offence. — His Worship imposed tho' following fines :—4os and costs, £2, in" the first case,.-10s and costs, ;C1 18s, in the second.;, and 10a and costs; £1 10s in the third.. Defendant said. "Well this is the lasb d.ay I .run., those 'buses. I. take them right off after to-day. It's too bad."
