« THE RIGHT TO RECALL CHILDREN.
An unusual case under, the Industrial ■■ Schools Acb came before Mr Northcroft, S.M., at the MagUtrabe'a Courb to-day, . ib being the first of the kind heard in Auckland. Alias Sarah Elizabeth Jackson, manager of the Industrial School, sued Richard ' James Owen, described aa a phonographer, ■ for 11s 6d, for wages of Isabella M. Cufch-. Bert from February 19bh to April 14th,' 1894 (being 7 5-7 th weeks) ab Is 6d per week, the said Isabella M. Cubhborb being an inmate of the Industrial School and licensed to reside with the defendant during the period mentioned. Mr McAlister appeared on behalf of thief Education Departuionb. Defendant ap- ; peared in person. Mr McAlister said the case was brought' as a matter of principle. Tho child.; Cuthbert was ordered to be sent to the Industrial School by a magistrate, and was duly licensed out under the Act to defendant at la 6d per week and maintenance. Miss Jackson, the plaintiff in traction, requested the child to be returned to the Institution, and in answer '. bo her requests defendant Bent a letter';, stating thab he would detain the V child "until eho can show some t higher authority than a fanciful whim." /" Evidence was given by Miss Jackson who stated that she was compelled to go to get ■*■■ a warrant from the Minister of Education , \ to enforce her right as matron of the Indus* I trial School to get the girl returned. ■~•'•' Defendant submitted that there had been a breach of agreement. He had faithfully kept his parb of the agreement, and no 7 reason had been assigned for the removal of,, tho child. , 'M-] In reply to a further question from da*/:. fondant, Miss Jackson said she declined to answer why she withdrew the child. < Mr Northcroft then gave judgment for '. plaintiff with costs £1 7s.
