Traffic Inspector, represented the prosecution. A number of the employeos of Mr Bowden,- cab proprietor, were examined, with the object of .proving thab Keenan had driven a cab along 'Queen-street on the nighb of bhe 4th of June.—On tbe case for the prosecution closing, Dr. Laishley submitted to the Bench that bwo very serious omissions hod been made by bhe prosecution which were fatal to their case, viz., that the section of tbe bye-law referring to this particular offence had not been inserted in the charge, and secondly, the Traffic Inspector, the only person who issued licenses to cab drivers, bad neglected to go into the box to prove that the defendant wbb nob the holder of a license.-—His Worship said that on those objections alone, even if he heard fifty witnesses for the prosecution, he would have to dismiss the case.—Dr. Laishley thought that in order to prevent the charge being again brought, ib would be advisable to hear the dozen witnesses ho would call to prove that on the evening mentioned Keenan was merely showing a new employee of his round the town, thab he had nob driven.the cab, and that this new mathad taken oub a licen.e on the day the offence was supposed to have been committed.—The Bench remarked ibwas useless to spend the time of the Court in thab way, for if bhe caae were brought a second time before him he would certainly dismiss it.—Dr. Laishley then applied for costs, but these were disallowed.
