o ■ (Before H. W. Northcrofb, Esq., S.M.) judgment. Point Chevalier Road Boaed v. Thk Mayor, Councillors, and Citizens 'oj Auckland,— This was a claim to recover £20 16a Bd. Tbo facia had been stated and the case argued before the Magistrate by Mr Theo. Cooper (for plaintiffs), and Mr Cotter (for defendants). The claim was for two years' rates from defendants as owners of part lob 17, section 9, known as the waterworks property at the Western Springs. The City Council claimed to have taken in the land for waterworks purposes.—Judgment was given for the City Council with costs £2 2a. t. and s. morrin and co. v. captain Firth and the Owners of the s.s. Indramayo.—This waß a claim to recover £17 16s on 13 reels barbed wire, 3 coils fencing wire, and 1 cast iron bath (part) short delivered).—Mr C. F. Buddie tor plain biff, Mr S. Heslcebh for defendants.—ln this caee evidence was taken and counsel's argument heard on previous Court days.—Mr Northcroft now gave judgment for £2 17s 6d (the plaintiffs to retain the goods) with coßts £4 15s. TAKING OF EVIDENCE. Teßopihav. Thos. Jas. Steele.—This was a claim to recover £11 2s 3d, for Bar-> vices as a witness in a Supreme Court.' case.—Mr W. R. Bloomfield (instructed by Mr Rose, of Napier) appeared for plaintiff. —Plaintiff in the case is a native lad of twelve or or fourteen years of age, and resides ab Wairoa (Hawke's Bay). Defendant, now living in Auckland, gave evidence. He deposed that he paid the amount claimed, and produced a receipt signed by plaintiff. The receipb was in the handwriting of one, T. C. Webb, and was interpreted to plaintiff by Wm. Hamilton, a hali-caste, who, he believed, was a relative of the plaintiff. The amounb was paid in instalments. The evidence of defendant will be forwarded to Napier.
