WALTER TIBBUTT'S CASE.
ONE CHARGE DISMISSED.
At the R.M. Court! thia morning, before Mr H. W. Northoroft, R.M., Walter Tibbutt, a bankrupt, was charged on remand with attempting to abscond from the colony of New Zealand, taking with him property to the value of £20 and upwards. Mr McAllister appeared for the prosecution, and Mr McGregor for the defence. Evidence was given by Mr John Nesbib and Isaac Mendelsshon, relative ts a gold open faced lever watch, gnld albert, locket and ring, which had been pawned by the former on behalf of Mr Tibbutt. The articles were released on the 12tb December, 6 days before the accused tiled. William Maud was called by the defence, and aaid the gold watch was not worth more than £3.
Mr McGregor contended that the prosecution had failed to prove that the accused had goods to the value of £20 or upwards in hie possession when he intended to leave the colony, and the R.M. upheld this objection and dismissed Tibbutt. Two othor charges preferred against Mr Tibbutt under the new Bankruptcy Act are to ba heard to-morrow.
