The action of Penglaze v. the Bank of New Zealand was tried in March last, when the judge refused to admit evidence tendered by the Bank to prove that certain deeds were lodged as security, and gave judgment for plaintiff for ,£IO,OOO, to be reduced to is when the deeds were delivered. The Bank appealed and the full Court decided that the primary judge was wrong in refusing the evidence, and ordered that the case be heard over again.
