NAPIER PARK RACING CLUB V. CAPTAIN RUSSELL.
A curious sporting case was beard in the R.M. Court at Napier yesterday. The Park Racing Club sought to recover from Captain Russell, M.H.R., the amount paid in the Hack Race won by his horse Van Diemen. The published conditions read: —" A hack shall mean a horse that has never started in a weight-for-age or handicap race, hack races excepted, or that is nominated in a Derby, Oaks, Guineas, or St. Leger at the time pf nomination." After the payment of the stakes the owner of the second horse protested. Van Diemen was disqualified, having been entered for the Derby and Guineas. Tho club paid the stakes again to the owner of the second horse. Captain Russell refused to refund, claiming that so far from being disqualified, his horse was the only one qualified under the published definition of a hack. Judgment was reserved.
