TOTALISATOR CASE.
At the R.M. Courb to-day George Bruce claimed to recover from Samuel Lindsay £2 6s, alleged to have been paid in error to the defendant on the 26th of October in the inside totalisator ab the Auckland races on tho hurdle race.
Mr G_N. Brassey appeared for plaintiff, and Mr C. E. Madden for defendanb. The circumsbftnees of the ease were eomewhab remarkable. The plaintiff was ab tho races, and the money, it was alleged, Was paid by mistake to the defendanb.
George Bruce deposed that he was ab the race, and paid £2 6s dividend to defendant in mistake for Mr Charles Whibbon, who handed him bhe ticket fco collect. In the hurry and crowd he made the mistake. When Mr Whitton asked for his money, witness discovered his mistake. He wenb to defendant, Who then stated that he had given Wifcness £1 to pub on the machine for him. When he saw the two mon together he could toll which had handed him the ticket. Wifcness know bobh Mr Whittan and Mr Lindsay. When fche ticket Was handed bo witness he took It to be Lindsay's. Charles Whitfcon, dealer, Wellesley-streefc, deposed to handing his ticket to the last witness to.collecb. Did nofc geb his money, as Bi'uce paid ib fco defendant. Wibriess saw the money paid bo Bruce. Afbertfards offered bo pay back half bhe money bo Brtice. Lindsay said he had given Brtt.6 £1 bo geb him a ticket. William Smith gave corroborative evidence.
The defendant stated that ho had given i Mr Bruce a sovereign to get him a tl&kefc, Bruce afterwards gave witness £2 69. Corroborative evidence Was alSo given a jockey named Kafcterne. Ultimately His Worship gave judgment fOf def.hdant, with costs £1 9s.
