GAMBLING AND FIGHTING
At the Police Court to-day Frederick Pike was charged witli having on the 22nd of April, ab Onehunga, assaulted Edward Hogan. Defendant pleaded net guilty. Mr T. M. Humphreys appeared on behalf of the complainant. Edward Hogan deposed that he was a horse dealer. The defendant worked at Mr Glanfield's, Onehunga. On Easter Monday witness was playing cards with defendant at Molloy's. The defendant hit him unprovoked. Subsequently, when they gob outside, defendant called witness on one side and spoke about his sister, after which he hit witness in the eye, on the nose and other yjarts of the head. Witness was put in ci cab and sent home. Witness was courting defendant's sister, and he disapproved of the match.
By defendant: "We were gambling. We were throwing dice."
His Worship sidd yon were playing cards?" Witness: "I told my lawyer it was throw in? dice, but he said it did nob matter so longc as it was gambling." His Worship: "It matters whether or not you are speaking the truth." Charles Neave deposed to accompanying Hogan to Ternahan's Hotel, when he saw defendant strike Jiogan eeveral times. Did not see Itogan give any provocation to Pike. Win. Shaldrick also gave evidence fortli6 prosecution. Frederick Pike, the defendant, then gave evidence. He stated that his proper name was McPike, and the information wae amended accordingly. Defendant said that he struck at complainant, bub did nob hit him. He received provocation from Hoean. The Bench commented upon the evidence, and said that there must have been provocation. Ho would therefore merely inflict a fine of 20s and costs, or in default one week's hard labour. His Worship would not allow counsel's fee, as he considered that the case ehould not have been brought in the Auckland Court, but at Onehunga, where the offence was committed.
