(Before H. G. Seth Smith, Esq., R.M.) DEFENDED CASE. (3ave v. R, Johnstone.— Claim, L 46, for •ongful appropriation by the defendant of y-and sundry articles belonging to tho untiff.—The chief evidence, in this case , gave in our last night's issue.-Mr ible, proved purchasing same hay from mat 15 per ton on the ground at Takaina . Did not.say lie would take the whole if at that price. Had not seen the hay Mhe offered that price. Was satisfied i.h the hay.-By Mr Mahony: Thederidarit. simply took the hay to get spmeing out of the plaintiff, as he owed him ciney. The hay was wdrth about 50s a n in Auckland. Plaintiff still owed him on6 y which he could not get. Would not retaken anymore hay than would wipe tfc.the acclSnt. —Mr Mahony here oVed for a nonsuit, as there wa.3 no proof possession on the part of defendant.—Mr igty then called upon Mr Maboney to proice a letter; that gentleman refused to do ~_His Worship held that as there was idence of the goods in question having enTased by the defendant, conversion of was established according to law.
