The witness noticed that the upper portion of the ear had been cut away. The prisoner stated that his horse had reared and thrown him back, and rolled on him, and his ear came into contact with a piece of glass, which had cut off the upper portion. Hie prisoner produced the piece of his ear, and at first asked if it could be replaced, and, upon being told that was impossible, asked if his other ear could not be cut to match. Witness dressed the wound. Ib was a clean cut. On the following Monday the prisoner again visited him, and asked to have his back examined. Witness found a bruise upon his back about the width of two fingers. On the next Wednesday the prisoner again visited witness, and asked to have his thighs and private parts examined. Witness did so, and found no marks on the lower portion of prisoner's body. The prisoner on this occasion said he had been attacked by some Maoris, and that was how he had received his injuries. He also showed a severe bruise on the arm. —By Mr Cotter : Had the prisoner been maUreated, as stated by the two previous witnesses, evidence of such injuries must have .remained even after the lapse of four days from the Saturday until Wednesday.—-Honi Kuruni deposed to being in a house near the potato field on the day. in question. He heard some one calling out, " Oh, Rewi arid others." 'Rewi was a native, who was also in the hut. The cry was one of pain. Witness ran in the direction of the voice. It was a woman's voice. Upon arriving he found Hariata Mimiha striking the prisoner. He saw Hariata under Charley Wight. He heard prisoner say, " Don't cut my ear. I will give you L 50." Hoerata asked witness, "Where is the LSO ?" Prisoner said, "At my house." Hoerata, believing that he would never get the LSO, cut off prisoner's ear. Teta and Mariati and their husbands slept in the same whare with prisoner that night. — Mr Cotter cross-examined the witness Honi Kuruni last night until he contradicted the evidence of some of the previous witnesses. —It was then decided to adjourn until 9 o'clock this morning.
