MOUNT WELLINGTON AND OTAHUHU ROAD BOARDS.

The Stoppage of roads question between tho Mount Wellington and Otahuhu Roud Boards was introduced to-day in the Iv.M. Court, before Judge Smith, by Mr James Russell, on behalf of settlers in I'anmure and the Otahuhu Board. Mr S. Hesketh appeared for the Mount Wellington Board, and asked that Mr Busisoll would state his objections, which would afford him a fair opportunity of answering them, or if he should be prepared fully to answer them, the matter might be adjourned to a iixed day for going fully into the matter. Mr Russell then stated tho objections to the closing of tho three roads:—(l) There was a good watering placo in No. 1 road, and it communicated with the Tamaki river; (2) it was against the wish of the ratepayers, and against the public interest; (3) at the meeting it which the resolution was passed the provisions of the Public Works Act of ISS2 had not been complied with (sec Sec. 04, Sub-sec. 5), which prescribes that the Chairman of tho Board shall preside. The Chairman did not preside at that mooting; honco tho meeting was irregular, informal, and invalid. Again, the three roads —1, 2, and 3—were embodied in one resolution, whereas they should have been taken seriatim and dealt with separately. Mr S. Hcskcth replied that he could at onco meet some of the objections ; others he could not meet at the moment. After noticing the several objections, Mr 5. Hesketh submitted that some evidence should be taken and a day lixed for the disposal of tho difficulty evidence might be taken on affidavits to save expense. Mr Russell suggested a country ride round the neighbourhood of the road. His Worship said before he could form an opinion or settle the difficulty, it would benecessary for him to visit the places. It was finally agreed toget all tho evidence possible on both sides, and to charter a conveyance for a trip to the localities by His Worship and the solicitors on Monday, the 16th October, starting at good time in the morning.
