TRUSTEE ELECTION.
The first case of disptued election of highway trustees in New Zealand was heard before the R.M. this morning. Mr Heskech appeared for the plaintiff, Mr George' McLeod. Mr J. D. Gatiand, the ReturningOfficer, was the defendant. Mr McLeodj" sworn, stated that he was a miner in the Coromandel Highway District, and was rated at £15 10s for house and/grounds on Ring's ■ road. He paid the rates on the 28th June, and also was,,-,rated for; allotments on Wynyardton, which he had not paid. He was nominated-as candidate for trustee of the Higliway-Boa.rd'by.Messrs Eraser and Tinne, and that hisname,did not appear on the pollingMpapem,on notice posted of candidates. Mr Gatland- sta.ted^ that his' reason for vntit ...putting ■ the; 'name> of ■McLeod onv;the J»pe*«'. that itwas not o^ theroll-^p,flwsh ed-hiia.by. thk-Secretary of the HighwayßAa.i<d; I liie Clerk of the > Court . produced ballo.t. papers and roll sealed." He was ordered^tp' open them aiid produce one and read it. lie found the Bame-of McLeod not on. tie. read another-'upon i which the name was not on. Mr • -William BTdrne Secretary of the Hiahway Board stated that he kept the roll The ratepayers-book was produced and MeLever's name found on forone Property havia- paid rates for. He concluded under section 10 of the local act that unless all rates are paid upon the various Properties a person is not entitled to be put on the roll. The R M. reserved his decision until Monday but intimated that in his opinion the election would be void. A special reporter from the " Herald" was sent down.
