IN BANCO,

(Before his Honor Mr Justice Gillies.) Grattan v. Giles.

JUDGMENT,

This was an action for ejectment brought by tho plaintiff to recover possession of a piece of land from defendant. The land was originally mortgaged by Giles to the Melanesian Trust, and there was a second mortgage to tho Ute Richard Grattan, who died intestate. The action is brought by the widow as administratrix of the estate, who. to avail herself of tho mortgage to her husband, obtained an assignment of the first mortgage to the Mission Trust by paying tho consideration money. A first action was brought in her own right, and was stopped upon a domurrer. The present action is brought as administratrix. The present proceeding is a demurrer |to the declaration, and the argument took place last Court day. His Honor now pronounced judgment for the plaintiff with costs. This was all the business.
