(Before his Honor Judge Beckham, KM.) OHIO GOLD MIXING COMPANY^. FISCHER. Mr Warner appeared as official agent for the Company, and stated that the creditors had consented to accept 8s 9d per share, thup reducing the contributions one-half. His Honor ■ thought this was the moat equitable course for the creditors to lake. The second schedule was therefore confirmed. CTJNDALL V BLEWDE2T. Mr Laishley appeared for the plaintiff in this case, and Mr McCormick and Mr Brock for the defendant. This action was brought at the lnstanceof Mr Thotaas Macffarlane as trustee of plaintiff's estate for the recovery of adebtof £72; and the defence was that plaintiff, being adjudged a bankrupt at the time, had fraudulently obtained the goods winch constitute the present claim. • Robert Cundall deposed that in September last he took steps towards filing a schedule of bankruptcy. . . ;... Mr McOormick objected, as witness could not be examined on this point. The necessary documents and the Oame proving plaintiff's bankruptcy were thai put in and considered conclusive as to the bankruptcy. Witness proceeded to saythatmconsequence of an order of adjudication having been made against him he filed statements of accounts in the Supreme Court ; he sold twoidrays, two horses, and the harness to defendantion the Ist day of September, 1873, for £50, but as at that time he owed a debt of wow Blewden he only received the balance oi. £15. He did not make any written recora of the sale, but he believed it was ontneist of September. He did state on a previous occasion that it happened in NoTerotier, although, pressed to do so. Thomas Macffarlane, of the BanlrnptcT; Court, gave evidence as to the baakruptcyoi Cundall and that he had asked Blewto respecting the horses, drays, and harness, dv» that he had refused to give them up although repeatedly requested to do so. c .
