Monday, 11.30 a.m. On Saturday a rumor was current that a case of small-pox had occurred at Te Aro, at the end of the town. An enquiry into the matter showed that Mr. Kaye, recently mail agent on the Nebraska, was attacked with smallpox in a mild form. The General Government sent for Dr. Johnston; health officer* : who advised the removal of; Mr Kaye to the quarantine ground. , , . The patient, with two of the armed constabulary, with medical comforts, hasbeen'sentoff. The patient acquiesced in the removal, otherwise, in the absence of the Public Health Act, he must have remained at his residence.

The disease is only mild. The Government have instructed the Board of Health of Auckland to take precautions against the introduction of small-pox in vessels from San Francisco by having the mail bags fumigated. The Appeal Court gave judgment to-day in the case of Smythies, the attorney. It regretted that it could not grant the prayer of the petition' as Smythies had not satisfied the Court that his conduct had been absolutely upright as required by the Act. The conviction of M. Power for forgery has been quashed by the Appeal Court.
