WARDEN'S COURT.-Yesterday.
(Before \V. Fraskr, Esq., lUt,, Warden.) Mining Inspectok v. Joes Gkahaji. —This was a plaint laid by the Mining Inspector against John Graham that he, being the registered owner of the Koyal Crown claim, Waiotahi, failed to continuously work the same in a bona-fide manner, The plaintiff claimed (hat. the defendant be adjudged to have forfeited the said claim. The claim in question consisted of an area of 2L acres on the Waiotahi Spur, adjoining the Waiotahi, City of York, Exchange, and Prince Imperial. It was marked out on the 18th of November, 1873.—Henry Goldsmith, Mining Inspector, deposed that the cause was laid under the 22»d section of the Mining District Act. of November, 1873. It had not been worked since. It was on the site of the Leeds claim applied for by Wickham, and no objection had been lodged.—The plan of the Leeds was submitted.—By defendant : I am not aware that the ground has been in dispute, nor that there was a lawsuit pending, It might have been when it was the Prince of Wales.—Albert J. A Horn produced the register of the Koyal Crown claim. John Graham was the registered owner, and no change had taken place. Defendant said the ground had been in dispute for a long time with Wickham, Garvey, and Punch.-Defend-ant was then sworn. He said: He never knew of an application for part of the ground by Wickham until to-day. Upon being further questioned ho admitted that there had been an arrangement with Wickham that he (defendant) should get sorao shares in case Wickham gained some lawsuit, but that was some time ago.—His Worship declared tho ground forfeited, without costs..
