When John Jamieson's action against the Chalmers Church was before the Supreme Court last month, counsel for the defence raised the question as to whether the Attorney-General and the trustees of the Foreign Missions Board should not be joined as parties to the transaction. In an interesting interim judgment this morning, Mr Justice Sim held that where an action was brought to remedy any clause or misapplication of charitable funds the Attorney-Gene-ral is the proper plaintiff. The present suit was not allowed to proceed until he had been added as a party. It would be sufficient if the Attorney-General was added as a defendant. [ln the action Jamieson v. Deacons' Court, John Jamieson sued for the removal of the Deacons' Court of the Chalmers Presbyterian Church congregation from the trusteeship ,of the church, and the appointment of other persons in their stead. The dispute involved the form of service adopted by the church, plaintiff desiring the congregation to stand in prayer and sit in praise, whereas the present Deacons' Court ordained that the opposite should obtain.]
