OBSTRUCTING A WATERWAY
SUPREME COURT DECISION.
Judgment was given, by his Honour Mr. Justice Hosking to-day in the case of Francis H. Guildford v. Alfred Mildenhall, claim for damages for obstruction of tho Ngahatu'anga Stream. In giving judgment his Honour said that the parties are the respective proprietors of -two adjoining sections at Johnsonville. Each section is intersected by the Nga-hauranga Stream. Some years ago defendant erected a workshop and abridge across the bed of the stream. He had also placed a frame of wire-netting in the bed of the stream to prevent trespass under the workshop. Plaintiff's land Avas flooded, and the allegation was that the flood occurred in consequence of the obstruction caused by defendant's structure causing an obstruction in the stream. His Honour gave judgment for £5 damages, and also issued a writ of injunction restraining defendant from continuing any obstruction restricting the carrying ca-pacity of the bed of the creek; with costs against defendant on the lowest scale.
