CLAIM FOR DAMAGES
In the Supreme Court to-day his Honour Mr. Justice Hosking commenced the hearing of the case of Henry Thompson Johnson, Frasertown, Wairoa, settler,' against Charles W. . Martin, Tory-street, Wellington, plumber. Mr. A. W. Blair appeared for the plaintiff and Mr. T. Neave for the defendant. The statement of claim alleged that the defendant agreed to instal a Norvic gas lighting, heating, and cooking plant for £128. and guaranteed that it would be satisfactory. He also contracted to supply some patent . flooring. Plaintiff alleged that the lighting and flooring proved to be unsatisfactory, and that in January, 1914, defendant agreed to erect an up-to-date electric lighting plant iii exchange for the gas plant, on payment of an additional £35. ' It was alleged that defendant failed to carry out that agreement, and plaintiff therefore sued Martin for £180 16s Bd, the value of plant and damages. The defence was a general denial of all the plaintiff's allegations.
The case is proceeding.
