ABOUT A PROMISSORY NOTE
A firm of - carriers, L. C. Burke and *Company, of Wellington, to-day sued William C. Aubrey, of 49, Majoribaukestreet. land agent, to recover the sum of £50 on a promissory note. Dr. M'Arthur, S.M., wae on tho Bench. Plaintiffe set out that defendant, was holder of the note, which was dated 12th August, 1910, which wae made by* Arthur C. Rose, a signwriter, and payable three months after date to the Wellington Loan Company, Ltd., or order, to whom the defendant endorsed the note. On presentation of tho note it wae dishonoured, and notice of the dishonour was given to the defendant. Plaintiffs also claimed £1 5s 4d intorest, at the rate of £8 per cent, per annum down to the date of judgment. Mr. F. G. Bolton represented the plaintiffe, and Mr. V. R. Meredith the defendant. The defence was that tho money was raked for the benefit of Rose, for whoee accommodation the note was endorsed. Tho bulk of the money Went to Rose, and 6omc of it to Burke. That being so, both were , liable for the amount of the bill to the Loan Company. After heai'ing evidence, His Worship gave judgment for plaintiffs for tho amount claimed.
