(2) Age about twenty-three, height about 5 ft. 9 in., medium build, fresh complexion, fair hair, large eyes, thin face ; dressed in a grey suit (no hat). About 10.45 p.m. complainant discovered the accused men in a room on his premises. They assaulted him and then decamped. No warrant.

Auckland. 4th instant, for assault with intent to commit rape, Man (name unknown), age about thirty-five, height 5 ft. 8 in., medium build, prominent nose believed to be a Roman nose ; wearing a dark tweed overcoat and felt hat pulled down over forehead. At about 12.25 a.m. while Marjorie Jean Hamilton was walking in St. Stephens Avenue she was thrown to the ground by accused who attempted to rape her. No warrant.

Accused procured a blank cheque on the Bank of New Zealand, Ngaruawahia, from Guy Marriott, filled it in for £3, signed it “ R. Western,” and obtained a bottle of hair lotion, value 3s. 6d., and £2 16s. 6d. cash from Marjorie Mary McGruer, hairdresser, by means of it.

Gisborne.— l6th instant, on warrant of commitment to Napier Prison for twenty-one days in default of paying £l2 19s. fine and costs for supplying liquor to Natives in a proclaimed area, Joseph Patrick Morcan, age forty-five, height 5 ft. 10 in., labourer, native of New Zealand, medium build, fresh complexion, brown hair, grey eyes, right arm amputated. New Plymouth. —l3th instant, on warrant for deserting from the ship “ Antigone ”(1) Wilfred Biggins, age twenty, height 5 ft. 5 in., seaman, native of England, medium build, dark complexion, dark-brown hair, hazel eyes. (2) A. J. Coles, age eighteen, height 5 ft. 11 in., seaman, native of Wales, slight build, fresh complexion, fair hair, blue eyes.

New Plymouth. —l7th instant, on warrant for false pretences, W. A. Pitts, age about forty, height 5 ft. 10 in., salesman, native of New Zealand, medium build, dark complexion, dark hair going bald, boil-marks on back of neck, has small moustache ; dressed in a navy-blue suit with fine white stripes, fawn overcoat, green scarf with white spots, and green hat. He stayed at the Hotel Imperial from the 14th to the 17th instant, and on the latter date he obtained from Dulcie Eileen Storey, clerk at the hotel, £2 7s. 9d. cash by means of a valueless cheque for £4 7s. 9d. (which he tendered in payment for his accommodation), No. C. 195067, drawn on the Bank of New Zealand, New Plymouth, in favour of W. A. Pitts, signed R. J. Stirling, and dated 16th May, 1938. The photograph of William Arthur Pitts, alias Robert William Malcolm, referred to in Police Gazette, 1937, page 800, and Photographs, page 10, has been identified as that of accused. Accused procured a blank cheque-form on the Southland Building Society from James Carter, forged the signature of Wallace Murdoch, 217 Elies Road, to it for £lO, and uttered it to the Building Society, Invercargill, where he was paid out £lO 10s.
