Regulations under the Defence Act, 1909, constituting Military Districts, Groups, and Areas. LIVERPOOL, Governor. I ARTHUR WILLIAM DE BRITO SAVILE, Earl of Liverpool, the 5 Governor of the Dominion of New Zealand, do hereby, in exercise and pursuance of the authority conferred upon me by the Defence Act, 1909, make the following regulations under that Act, and declare that they shall come into operation on the twenty-fifth day of September, one thousand nine hundred and sixteen.

REGULATIONS. 1. The Dominion of New Zealand is hereby divided for the purpose of the Defence Act, 1909, into four districts, to be termed military districts, under the respective designations and with the respective boundaries set forth in the First Schedule hereto. 2. Every military district is hereby divided into groups under the respective designations and with the respective boundaries set forth in the First Schedule hereto. 3. The provisions of the First Schedule as to boundaries of military districts and groups shall be read subject to the general provisions contained in the Second Schedule hereto. 4. Every group may be divided into such areas and subdivided into such subareas, with such designations and boundaries, as the Commandant from time to time directs. 5. (1.) Clause 5 of the Regulations for the Military Forces of New Zealand, made on the 22nd day of December, 1913, and gazetted on the 23rd day of January, 1914, is hereby revoked, and the military districts, area groups, and areas thereby constituted are hereby abolished. (2.) All references to military districts or to area groups in the said regulations or in any amendment thereof shall be deemed to be references to the military districts and to the groups respectively as constituted by these present regulations.

FIRST SCHEDULE Auckland Military District. Comprising the following groups : No. 1 (Auckland) Group. Comprising the counties of Vvaitemata, Eden, Manukau, Franklin, and Great Barrier Island, together with Little Barrier Island and all islands in the Hauraki Gulf.

No. 2 (Hauraki) Group. Comprising the counties of Coromandel, Thames, Ohinemuri, Piako, and Matamata. No. 17 (Bay of Plenty) Group. Comprising the counties of Opotiki, Whakatane, Tauranga, Rotorua, and East Taupo. No. 3 (North Auckland) Group. Comprising the counties of Mangonui, Whangaroa, Hokianga, Bay of Islands, Whangarei, Hobson, Otamatea, and Rodney. No. h (Waikato) Group. Comprising the counties of Raglan, Waikato, Waipa, Kawhia, Avvakino, Waitomo, and West Taupo. Wellington Military District. Comprising the following groups : No. 5 (Wellington) Group. Comprising the counties of Hutt and Makara. No. 6 (Manawatu) Group Comprising the counties of Horowhenua, Manawatu, Kairanga, Oroua, Pohangina, Kiwitea, and Rangitikei. No. 7 (Hawke’s Bay) Group Comprising the counties of Hawke’s Bay, Waipawa, Waipukurau, and Patangata. No. 18 (Wairavapa) Group. Comprising the counties of Featherston, Wairarapa South, Master* ton, Castlepoint, Mauriceville, Eketahuna, Pahiatua, Akitio, Weber, Woodville. and Dannevirke.

No. 19 (Poverty Bay) Group. Comprising the counties of Wairoa, Cook, Waikohu, and Waiapu

No. 8 (Taranaki) Group. Comprising, the counties of Patea, Hawera, Eltham, Stratford Waimate West, Egmont, Taranaki, Clifton, and Whangamomona. No. 20 (Wanganui) Group. Comprising the counties of Wanganui, Waitotara, Waimarino, Kai tieke, and Ohura. Canterbury Military District. Comprising the following groups : No. 9 (Christchurch) Group. Comprising the counties of Waimairi, Heathcote, Paparua, Halswell. Mount Herbert, Akaroa, Wairewa, and Chatham Islands. No. 10 (South Canterbury) Group. Comprising the counties of Ashburton, Geraldine, Levels, Waimate, and Mackenzie. No. 11 (North Canterbury) Group. Comprising the counties of Amuri, Cheviot, Waipara, Ashley, Kowai, Rangiora, Oxford, Eyre, Tawera, Malvern, Springs, Ellesmere, and Selwyn.

No. 21 (West Coast) Group Comprising the counties of Westland, Grey, Inangahua, Buller, and Murchison. No. 12 (Nelson) Group. Comprising the counties of Collingwood, Takaka, Waimea, Sounds, Marlborough, Awatere, and Kaikoura. Otago Military District. Comprising the following groups : No. 18 (Dunedin) Group. Comprising the counties of Peninsula, Waikouaiti, and Taieri. No. Ilf. (Southland) Group. Comprising the counties of Southland, Wallace, Stewart Island, Lake, and Fiord. No. 15 (North Otago) Group. Comprising the counties of Waitaki, Waihemo, Maniototo, and Vincent. No. 16 (Clutha) Group. Comprising the counties of Clutha, Bruce, and Tuapeka.

SECOND SCHEDULE. Boundaries of Groups. 1. Each group shall include all cities, boroughs, and town districts which are included within the exterior boundaries of any county comprised in .that group. 2. Each group shall include all cities, boroughs, and town districts which are contiguous to the exterior boundary of any county comprised in that group, or which are contiguous to any other city, borough, or town district comprised in that group. 3. If any city, borough, or town district is so situated that the application of the foregoing provisions would place it in two or more groups, such city, borough, or town district shall form part of such one of those groups as bears the lowest distinguishing number in the First Schedule hereto. 4. For the purposes of the foregoing provisions a city, borough, or town district shall be deemed to be contiguous to the boundary of a county or of another city, borough, or town district, notwithstanding the fact that it is separated therefrom by a river, stream, or highway. 5. Except so far as otherwise provided in the First Schedule hereto every island not comprised in any county but adjacent to the coasts of New Zealand and within ten miles thereof, or lying within any gulf, bay, harbour, or other territorial waters of New Zealand, shall form part of the nearest group on the mainland. 6. All references in the'foregoing provisions and in the First Schedule hereto to counties, cities, boroughs, and town districts are references to such areas as existing at the date of these regulations, and the boundaries of the military districts and groups as hereby established

shall not be altered or affected by any alteration which may hereafter take place in the existence or boundaries of any counties, cities, boroughs, or town districts.

7. Any part of New Zealand which is not included in any group in accordance with the foregoing provisions of this and the last preceding Schedule shall form part of No. 1 (Auckland) Group as described in the First Schedule hereto. 8. In this Schedule the term "town district ” means a town district not forming part of a county. Military Service Act, 1916. —Constitution of Recruiting Districts

WHEREAS by section 32 of the Military Service Act, 1916, it is provided that the Minister of Defence may, for the purposes of that Act, by order signed by him, divide New Zealand into such recruiting districts as he thinks fit: Now, therefore, I, James Allen, Minister of Defence for the Dominion of New Zealand, do hereby, in pursuance of the authority so conferred upon me, order and declare as follows : 1. For the purposes of the Military Service Act, 1916, New Zealand is hereby divided into twenty-one recruiting districts under the designations set out in the Schedule hereto. 2. Each such recruiting district shall comprise the counties and other areas named or described in the Schedule hereto as comprised in that district. 3. Each such recruiting district shall comprise all cities, boroughs, and town districts which are included within the exterior boundaries of any county comprised in that recruiting district. 4. Each such recruiting district shall comprise all cities, boroughs, and town districts which are contiguous to the exterior boundary of any county comprised in that recruiting district, or which are contiguous to any other city, borough, or town district comprised in that recruiting district. 5. If any city, borough, or town district is so situated that the application of the foregoing provisions would place it in two or more recruiting districts, such city, borough, or town district shall form part of such one of those recruiting districts as bears the lowest distinguishing number in the Schedule hereto. 6. For the purposes of the foregoing provisions, a city, borough, or town district shall be deemed to be contiguous to the boundary of a county or of another city, borough, or town district, notwithstanding the fact that it is separated therefrom by a river, stream, or highway. 7. Except so far as otherwise provided in the Schedule hereto, every island not comprised in any county, but adjacent to the coasts of New Zealand and within ten miles thereof or lying within any gulf, bay, harbour, or other territorial waters of New Zealand, shall form part of the nearest recruiting district on the mainland. 8. Any part of New Zealand which is not included in any recruiting district in accordance with the foregoing provisions of this Order and of the Schedule hereto shall form part of No. 1 (Auckland) Recruiting District as described in the Schedule hereto. 9. All references in the foregoing provisions and in the Schedule hereto to counties, cities, boroughs, and town districts are references to such areas as existing at the date of this Order, and the boundaries of the recruiting districts as hereby established shall not be altered oi affected by any alteration which may hereafter take'place in the existence or boundaries of any counties, cities, boroughs, or town districts. 10. In this Order the term "town district” means a town district not forming part of a county. Dated at Wellington this 25th day of September, 1916.

L IVERPOOL, G ovemor. ORDER IN COUNCIL. At the Government House at Wellington, this second day of October, 1916. Present: His Excellency the Governor in Council. I ARTHUR WILLIAM DE BRITO SAVILE, Earl of Liverpool, the j Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby, in pursuance of the War Regulations Act, 1914, and its amendments, make the following additional War Regulations; and, with the like advice and consent, I do hereby direct chat these regulations shall come into operation on the ninth day of October, one thousand nine hundred and sixteen.

REGULATIONS. 1. Any Superintendent or Inspector of Police may, with the approval of the Commissioner of Police, make application, in the form No. 1 in the Schedule hereto, to the Licensing Committee of the licensing district in which are situated any premises held under a publican’s license, for the cancellation of that license on any of the grounds following, namely : (a.) That the licensee has committed a breach of the Licensing Act, 1908, or that he has committed a breach of any regulation made under section 3 of the War Regulations Amendment Act, 1916, relating to the sale of intoxicating liquor, or that he has committed a breach of any of the conditions of his license; or (b.) That he has permitted the licensed premises to be frequented by disorderly or disreputable persons ; or ( c .) That he has failed to conduct the licensed premises in an orderly manner; or (d.) That for any other reason (to be specified in the application) the licensee is not a fit and proper person to be the holder of such license. 2. (1.) Upon receipt of any such application, the Clerk of the Licensing Committee shall arrange a time and place for the holding of a meeting of the Licensing Committee to deal with the application, and shall notify the applicant of the time and place fixed for such meeting. (2.) The applicant may thereupon, with the approval of the Commissioner of Police, serve upon the licensee a notice, in the form No. 2 in the Schedule hereto, calling upon him to appear before the Licensing Committee at the time and place specified in the said notice, to show cause why his license should not be cancelled on die ground or on any of the grounds specified in the notice. (3.) Not less than ten clear days’ notice in writing shall be given to the licensee of the time and place fixed for the hearing of an application under these regulations. 3. (1.) On the hearing of an application under these regulations a Licensing Committee shall have the same powers of summoning witnesses and of hearing evidence on oath as it has in respect of proceedings before it under the Licensing Act, 1908. (2.) At the hearing of any such application the applicant may appear personally or by counsel, and may call evidence in support of the applicat ion.

(3.) The licensee may thereupon, either personally or by counsel, call evidence in rebuttal, and may call such other evidence as the Committee deems relevant to show cause why the application should not be granted. (4.) The applicant shall thereupon have a right of reply. 4. Upon the conclusion of the hearing the Licensing Committee may, on all or any of the grounds stated in .the application, cancel the license in respect of which the application is made if in its opinion it is advisable so to do in the public interest. 5. The provisions of the Licensing Act, 1908, relating to the conduct of meetings of a Licensing Committee shall, so far as applicable, apply to meetings of the Committee held under these regulations; and, in so far as such provisions do not apply or as these regulations do not extend, the Committee may determine its own procedure. 6. (1.) Upon the cancellation of any license under these regulations, if the licensee is not the owner of the licensed premises the Chairman

of the Licensing Committee may, on the request of the owner of the premises, order the licensee to vacate those premises. If the licensee fails to vacate the premises pursuant to the said order, he shall be deemed to have committed an offence against the War Regulations, and shall be liable accordingly. (2.) If the licensee is a lessee or sublessee of the licensed premises, the Chairman may, on the request of the lessor or sublessor, execute in the name and on behalf of the licensee an assignment or surrender of the lease or sublease, and such assignment or surrender shall have the same effect as if if were executed bv the licensee himself.
