EXTRACTS FROM NEW ZEALAND GAZETTE.

(From Gazette, 1910, pages 9, 10, and 18.) Regulations as to Taking of Whitebait in the Manawatu River and its Tributaries, PLUNKET, Governor. ORDER IN COUNCIL. At the Government Buildings, at Wellington, this thirtieth day of December, 1909. Present : The Right Honourable Sir J. G. Ward, K.C.M.G., presiding in Council. WHEREAS by Order in Council dated the sixth day of October, one thousand nine hundred and eight,

and published in the New Zealand Gazette No. 76, of the eighth day of the same month, certain regulations were made providing, amongst other things, for the use of setnets for taking whitebait: And whereas it is desirable to amend such regulations : Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the fifth section of “The Fisheries Act, 1908,” and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations amending the said regulations of the sixth day of October, one thousand nine hundred and eight:—

Regulations

1. Set-nets having an opening of not more that 9 ft. by 1 ft. may be used for the taking of whitebait in the Manawatu River and its tributaries. 2. No person shall use more than one set-net, or use a setnet and hand-net at the same time, or place a set-net or use any fishing-net within a distance of 2 chains from another net on the said river and its tributaries. 8. Any person committing a breach of the foregoing regulations shall be liable to a penalty of not less than £1 and not exceeding £2O, except where otherwise specially provided. J. F. WHEREAS it is enacted by “ The Fisheries Act, 1908,” that the Governor in Council may from time to time, by Order in Council gazetted, make regulations (to have force and effect throughout New Zealand or only in such waters or places as are specified in such regulations) for, amongst other things, imposing conditions and restrictions on the taking of fish, providing for the more effectual protection and improvement of fish, and prohibiting the use of nets or seines of all descriptions or of any specified description : And whereas by Orders in Council dated the twenty-first day of September, one thousand nine hundred and four, the twenty-third day of August, one thousand nine hundred and seven, and the twenty-first day of October, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 78, of the twenty second day of September, one thousand nine hundred and four, and No. 76, of the twentyninth day of August, one thousand nine hundred and seven, and No. 92, of the twenty-fourth day of October, one thousand nine hundred and seven, regulations were made prohibiting the use of nets at the mouth of, or entrance to, certain rivers and streams, including the New River Estuary:

And whereas by Order in Council dated the fourteenth day of December, one thousand nine hundred and nine, and published in the New Zealand Gazette No. 105, of the sixteenth day of the same month, regulations were made prohibiting the use of nets in a portion of the New River Estuary or in any river or stream running therein: And whereas it is desirable to revoke such prohibition so far only as relates to the New River Estuary and the rivers and streams running therein, and to make regulations relating to the use of nets, imposing conditions and restrictions on the taking of fish, and providing for the more effectual protection and improvement of fish therein : Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the prohibition of the use of nets made by the hereinbefore-recited Orders in Council so far as relates to the New River Estuary, and at or near the mouth or entrance thereof, and in the rivers and streams running into the estuary, but not further or otherwise, and doth hereby make the following regulations :

Regulations. 1. No person shall put, throw, drag, draw, or place, or allow to be put, thrown, dragged, drawn, or placed, any net of any description (except a landing-net) for taking trout in that portion of the New River Estuary above a right line drawn from Owi Point to the north-eastern boundary of Stanley Township. The point on each side of the river from which such line shall be drawn shall be marked by a post bearing the words “ Netting prohibited line ” : Provided that this regulation shall not prohibit the use of nets for the purpose of taking indigenous fish. 2. No person shall use a net or seine for the purpose of taking fish of any description in any river or stream running into any part of the New River Estuary, or in the estuary within a radius of half a mile from where the waters of the river or stream meet the waters of the estuary at low water, spring tides. 3. The Southern District Trout-netting Area prescribed by Order in Council dated the twenty-first day of October, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 92, of the twenty-fourth day of the same month, is hereby extended to include the waters at the mouth or entrance of the New River Estuary, and the waters of that estuary up to a right line drawn from Owi Point to the north-eastern boundary of Stanley Township, such line being marked as set forth in clause 1 of these regulations. 4. The penalty for breach of the above regulations shall not be less than £5 nor more than £SO. J. F. ANDREWS. Clerk of the Executive Council. Inspector of Sea-fishing appointed.
