BOY'S LKG FRACTURED DRIVER HELD NEGLIGENT Negligent driving led to Roy Lloyd Skewes, of Ngaruawahia (Mr J. F. Strang) being fined £5 by Mr J. Morling, S.M., in the Magistrate's Court, Hamilton, to-day. The proseoution was conducted by SeniorSergeant G. H. Lambert and arose out of an accident at Te 'Rapa on Labour Day, when the defendant struck and Injured a cyclist. John Somerville (12), who suffered a fractured leg in the accident, said he was cycling along the Great South Road with his sister on the same cycle. Rain was falling heavily. “I looked around before turning across the road,” he said. “Just then there was a flash of a car and I knew no more until I awoke lying on the grass.” The girl was not injured. Somerville was discharged from the Waikato Hospital this week. Cross-examined, Somerville said he had often ridden a cycle with his sister on the bar. He considered he had not altered the balance of his cycle in looking around prior to the impact. In a statement to Constable G. Tait, the defendant said he was travelling at 35 miles an hour. He drove in the centre of the road to pass the boy, who swerved out Just as he was passing. “Apparently the driver did not see the children,” remarked the magistrate, “and I think the accident speaks for itself."
