RENEWAL OF LEASE.
AFFECTED BY ACT. AN APPEAL DISMISSED. An appeal against the decision of Mr S. L. Paterson, S.M., in which he gave judgment for plaintiff for £B6 12s in a claim for rent was brought before Mr Justice Herdman in the Supreme Court, Hamilton, this afternoon. Appellant was Bhola Singh Kullar, farmer of Tatuan.ui (Mr N. S. Johnson) and respondent was James Nicholson, farmer, of Hamilton (Mr 11. J. McMullin). The facts of the case were that appellant had a lease of a farm property owned by respondent which expired on July 1, 1932. The lease contained a clause giving right of renewal to • appellant on the latter giving respondent one month’s notice in writing. Notice was given .on April 30, 1933. The National Expenditure Adjustment Act came into force on May 10, 1932, and the question for the determination of the Court was whether the new contract was affected by the Act and the rent automatically reduced. In dismissing the appeal with costs His Honour held that the Act applied. During the hearing, which consisted entirely of legal argument, Ilis Honour, referring to the National Expenditure Adjustment Act, remarked that it was not only confusing but injust in principle.
