INCIDENT AT TE RAPA. CONVICTED MAN’S ACTION. EMPLOYED BY CLUB. MAGISTRATE RESERVES DECISION. The magistrate. Mr- S. L. Paterson, in the Hamilton Police Court to-day, reserved his decision’ in a case -in which Vincent Henry John Brown was charged with unlawfully trespassing on the Waikato Racing Club’s course. ; In explaining the -circumstances Detective A. J. White stated that he saw defendant on the Te Rapa racecourse on November 19. He was taking tickets on the members’ stand having been employed by the Waikato Racing Club, He was convicted for an assault on the police during the Auckland riots in 193-2, and being a convicted person was thus prohibited from attending a race meeting. Mr N. S. Johnson, who appeared for defendant, stated that his client had been employed by the Waikato Racing Club >to take tickets. 'He was not loitering or trespassing, as he had the club’s permission to attend! . Mr Johnson submitted that in any case the club mcide the rules prohibiting such’ persons to enter the course, and he contended that the club -had the right to waive the rule in a particular instance 'if it so 'desired. Mr Paterson pointed out that in his opinion a rule made in the public interests could not be waived by the committee of the club which had appointed Brown to collect Pickets. Detective-Sergeant Thompson who prosecuted, added -that 'the Racing Club Committee did not know that Brown was a man who had been convicted. _____
