COUNSEL REBUKED.
PROCEDURE IGNORED. DISRESPECT CORRECTED. A stern rebuke to counsel was administered by Mr Justice Smith in the Supreme Court, Hamilton, this morning during the hearing of an assault case, when orders were given without application to the Bench. After giving her" Evidence a female witness was allowed to leave the court and His Honour drew attention to the fact. Counsel for the defence asked His Honour for ail order that all witnesses who had not given evidence should leave the court. The opposing counsel then turned with his back to Ills Honour as if to tell the witnesses to retire. "This is my court and I cannot have counsel and the police taking the matter out of my control,” observed His Honour. “Any order excluding witnesses from the court should come from me. There is a procedure to follow. I must not have orders given here and there without reference to me.” Earlier in the case when counsel asked a female witness if she would prefer to give her evidence in a ohair instead of standing in the witnessbox, His Honour observed that he preferred such applications to be made to him, Counsel forthwith apologised.
