DEALERS IN GOLD.

QUESTION OF A LICENSE. DETECTIVE’S APPEAL UPHELD. (By Telegraph.—Press Association.) WANGANUI, Thursday. Reserved judgment of Mr. Justice Reed, delivered In the Supreme Court this afternoon, upheld the appeal of Detective John Walsh against the decision of Mr. J. H. Salmon, S.M., in respect of information laid by the police against, a man who was dealing in second-hand gold. The contention of appellant wasthat, if the decision of the magistrate were correct, and people were allowed do purchase gold without a licence under the Second-Dealers Act, thieves would he afforded facilities lo get rid of their ill-gotten gains. His Honour’s judgment points out that the Act of J 90S is the consolidation of the Act of 1902. In arriving at his decision to uphold the appeal he has reviewed two important sections defining second-hand dealers, and points out that, to be excluded from the operations of the Act, the onus is on a person to show that he does not carry on the business or purchasing of second-hand articles except for the purpose of manufacturing articles therefrom. In this case, His Honour states, there wa's prima facie evidence that accused was a second-hand dealer without a licence and he had not furnished proof that he was manufacturing articles from the gold he was so purchasing.
